The Military Bought Combat Arms Earplugs to Protect You. It Didn't Work.

3M Combat Arms Earplugs were issued to different branches of the military from 2003 - 2015.

They were designed with 2 different ends: The yellow end was meant to allow only low level sounds like spoken commands through while blocking ballistic noises.

The olive green end was meant to completely block sound. 3M knew, but concealed from the military, that the earplugs would loosen and slip from the ear canal, allowing dangerous decibel levels into service members' ears.

Despite knowing the earplugs were defective, 3M sold its Combat Arms Earplugs to the US military and exposed servicemembers to the likelihood of hearing loss and tinnitus.

3M Settled a Lawsuit by the Department of Justice for $9.1 Million.

In 2018, 3M settled claims by the Justice Department that it knowingly sold the military defective earplugs for $9.1 million. The DOJ alleged 3M and its predecessor Aearo Technologies knew Combat Arms Earplugs were defective as early as 2000.

The DOJ settlement does not compensate injured service members for their hearing loss and tinnitus. Instead, you have to file your own claim to be eligible for compensation. Combat Arms Earplugs cases are consolidated in a multidistrict litigation (MDL) consisting of about 400,000 military members' cases.

MDLs make filing your case easier because most plaintiffs never have to go to court. The lead attorneys pursue claims on behalf of all injured plaintiffs, and you receive a settlement when it's resolved.
